General Terms of Use and Sale

1 — Preamble and Purpose

These General Terms of Use and Sale (hereinafter "GTU/GTS") govern the access, use and subscription to the paid services of the Classupp platform, accessible at https://classupp.com. They serve both as terms of use and as terms of sale for any subscription taken out on the platform.

The platform is published and operated by the company AOS FZCO, whose registered office is located at Building A2 Business Park, Dubai Silicon Oasis, Dubai, United Arab Emirates, holder of commercial licence no. 16490.

Classupp is a hosting platform for online academies where AOS FZCO acts as a growth operator. The purchase of a product or service through this site implies the user's unreserved acceptance of these terms.

2 — Definitions

• Platform — Refers to the Classupp website and all of its features.
• Company — Refers to AOS FZCO, the publisher of the Platform.
• User / Customer — Any natural or legal person accessing the Platform or subscribing to its services.
• Services — The hosting of academies, the provision of educational content and community management tools.

3 — Access to the Platform and Registration

Access to Classupp's services is reserved for persons aged 18 or over. Minors are not authorised to register as users.

Upon registration, the User undertakes to provide accurate, complete and up-to-date information. The User is solely responsible for maintaining the confidentiality of their account and credentials.

4 — Description of Services

Classupp provides a technological infrastructure for hosting communities and educational content. As a growth operator, AOS FZCO provides tools to facilitate the development of the hosted academies.

5 — Customer / User Obligations

The User is strictly prohibited from:

• Using the platform for illegal or unauthorised purposes.
• Downloading, reproducing, storing, capturing or duplicating the platform's content (videos, texts, images) in violation of intellectual property rights.
• Hindering or disrupting the operation of the servers or networks connected to the platform.
• Impersonating a third party or a Classupp employee.

6 — Prices, Taxes and Payment Terms

Subscription prices are displayed inclusive of all taxes, in euros. The amount paid includes the value added tax (VAT) applicable according to the Customer's country of residence.

Collection and remittance of VAT. In accordance with the European Union regulations on digital services, AOS FZCO collects VAT at the rate in force in the Customer's country of residence and remits it to the relevant tax authorities via the one-stop shop "OSS" (One-Stop Shop, non-Union scheme). The Customer has no tax formalitiesto carry out : VAT is included in the displayed price and fully managed by Classupp.

Business customers (B2B).A business Customer liable for VAT in the European Union may benefit from the reverse charge mechanism by providing a valid intra-Community VAT number ; the invoice is then issued exclusive of tax and VAT is owed by the Customer in their country.

Invoice. An invoice detailing the price exclusive of tax, the rate and the amount of VAT applied, as well as the total inclusive of all taxes, is made available to the Customer in their personal area after each payment.

Accepted means of payment. Payment can be made by debit or credit card (Visa, MasterCard) via our secure payment processor TAP Company.

7 — Automatic Renewal and Cancellation

Subscriptions taken out on Classupp are contracts of indefinite duration with automatic renewal. At the time of subscription, the User is clearly and beforehand informed of:

• the exact amount of each instalment, displayed on the payment page before validation;
• the frequency of the charge (monthly, on the same date each month, except for a plan of a different duration explicitly indicated);
• the automatic and recurring nature of the charge until cancellation.

The User expressly validates these terms by ticking the dedicated consent box on the payment page. A confirmation email summarising the amount, the plan and the date of the next charge is sent to them after each payment.

Cancellation. The User may cancel their subscription at any time, free of charge and without penalty, from their personal area (the "My subscription" section). For a cancellation to take effect before the next instalment, it must be carried out at least 2 days before the scheduled renewal date. Otherwise, the renewal of the current period is due, and the cancellation will take effect at the following instalment.

Access to the academy's content remains active until the end of the period already paid for. No renewal occurs after an effective cancellation.

8 — Refund Policy

In accordance with the regulations in force (in particular for EU customers), you have a withdrawal period of 14 days for online purchases.

Exceptions and limitations:

• No refund will be granted for subscription renewals that have not been cancelled within the 2-day notice period.
• The right of withdrawal does not apply to digital content once performance has begun with your agreement and your waiver of your right of withdrawal.
• No partial refund is granted for usage periods already started.

9 — Affiliate Program

• Refusal of inactive payments. We categorically refuse the payment of commissions for any position considered inactive.
• Removal for passive spillover. AOS FZCO reserves the strict right to delete the accounts of business introducers who would benefit solely from a paid position thanks to the spillover mechanism without providing personal work.

10 — Intellectual Property

All the content of the Classupp site (texts, images, videos, logos, software) is the exclusive property of AOS FZCO or its partners. Any total or partial reproduction is strictly prohibited without written authorisation. The "Classupp" trademark is protected.

11 — Limitations of Liability

The educational content, analyses or information provided on the platform are provided for purely informational and educational purposes. The use of the services is at the User's own risk.

12 — Anti-Fraud Policy

AOS FZCO applies a zero-tolerance policy towards fraud. Any suspicious or fraudulent transaction will result in the immediate cancellation of the order and the suspension of the account.

13 — Personal Data (GDPR)

In accordance with the GDPR and applicable laws, you have a right of access, rectification, erasure and objection concerning your data. To exercise these rights, contact our data protection officer: privacy@classupp.com.

15 — Applicable Law and Jurisdiction

These General Terms are governed by the laws of the United Arab Emirates. Any dispute relating to the interpretation or performance of these terms shall be submitted to the exclusive jurisdiction of the courts of Dubai.
